Nagel Rice has sued Amtrak on behalf of one of the conductors aboard the Amtrak train that derailed last week in Philadelphia. Emilio Fonseca, of Kearny, New Jersey, filed the lawsuit Monday in state court in Newark. Mr. Fonseca was a conductor on Amtrak Northeast Regional Train No. 188 when it derailed outside of Philadelphia killing 8 and injuring 200. The Complaint alleges negligence in the operation of the train. Mr. Fonseca suffered severe injuries including numerous broken bones and head trauma. He is hospitalized in Philadelphia and is not expected to be released for some time. His attorney, Bruce H. Nagel, of Nagel Rice in Roseland commented, “My client suffered terrible injuries in this accident and we are thankful that Amtrak has taken full responsibility. Our prayers go out to those who did not survive this tragedy.”
