Bruce Nagel and Greg Kohn settle personal injury action for $2.5 million after woman injured at baseball game

September 28, 2012 – Bruce Nagel and Greg Kohn settled a personal injury suit for $2.5 million.

Martha Phillips, a 49 year old woman with three children was struck in the head by a baseball which went through holes in the protective batting cage netting while attending her son’s high school varsity baseball game at Montville High School on May 8, 2009. Mrs. Phillips agreed to settle her case for $2.5 million after mediation with retired Judge Jack Lintner. Mrs. Phillips and her husband brought the lawsuit contending that Montville High School, its baseball coach and others were negligent in allowing a batting cage to be used that they knew had numerous holes in the netting.

Mrs. Phillips was sitting behind home plate on the bleachers, watching the game. During the game, two students from the Montville High School baseball team began warming up in the batting cage located along the third base line. Mrs. Phillips was struck in the left side of her head by a baseball that went through a hole in the batting cage netting. Mrs. Phillips has been diagnosed with a mild traumatic brain injury and post-concussion syndrome which has affected her memory and her cognitive functioning. She has been unable to work and still experiences short-term memory loss, difficulty concentrating, sensitivity to light and noise, difficulty formulating sentences, and cognitive issues.
