Nagel Rice has filed a class action in the New Jersey District Court against Volkswagen for their fraud and deception in selling its clean diesel engines. Volkswagen installed software that allowed the engine to turn on full emissions controls during emissions testing. Without those controls the cars pollute up to 40 times allowable levels.

Volkswagen has duped its customers into purchasing “clean diesel” engines that fail to meet emissions standards. According to the EPA, Volkswagen installed its deceptive software, called a “defeat device,” in at least the following diesel models of its vehicles: Jetta (model years 2009 – 2015), Beetle (model years 2009 – 2015), Audi A3 (model years 2009 – 2015), Golf (model years 2009 – 2015) and Passat (model years 2014 – 2015).

Volkswagen’s U.S. CEO said they “totally screwed up”. He further stated that “Our company was dishonest with the EPA, and the California air resources board and with all of you, and in my German words: we have totally screwed up.”

Any fix by Volkswagen will likely adversely affect fuel economy and performance of the cars and the resale value of cars could be affected.
