A New Jersey football fan has filed a class-action lawsuit in federal court accusing the NFL of violating the New Jersey Consumer Fraud Act in the sale of Super Bowl tickets. According to the complaint filed in Newark federal court, Josh Finkelman of New Brunswick claims that the NFL only made 1% of the tickets available to the public forcing most fans to purchase tickets in the secondary market at high inflated prices. The large majority of the tickets are made available to the teams, media and other league insiders, all in violation of the New Jersey law that requires 95% of all tickets to be sold to the public. According to the complaint, the NFL already enjoys tax-exempt status and reaps billions of dollars in lucrative television contracts, stadium subsidiaries, and deals with the sellers of the tickets in the secondary market. The attorney for the Plaintiff, Bruce H. Nagel of Nagel Rice,LLP in Roseland, said, “The real fans are getting squeezed by the NFL’s unlawful ticket sales policy and they need to correct this ongoing wrong.” Nagel Rice is seeking treble damages which it estimates in the hundreds of millions.
