David DiSabato is counsel at Nagel Rice and specializes in complex class actions and consumer protection litigation. He has extensive experience representing clients across the country in both state and federal courts.
Dave was recently appointed class counsel in Page, et al. v. Ford Motor Company, Case No. 2024LA000148, Sangamon County, Illinois ($17.5 million settlement on behalf of employees alleging that their employer had impermissibly requested genetic information in the form of family medical history as a condition of employment); Reedy, et al., v. Everlywell, Inc., Case No. 1:24-cv-02713 (N.D. Ill.) ($5 million settlement involving allegations that an on-line seller of test-kits wrongfully installed tracking tools on its website in violation of various privacy laws); Story, et al. v. Heartland Payment Systems, LLC, Case No. 3:19-cv-724 (M.D. Fla.) (preliminarily approved as class counsel in $18.25 million settlement concerning allegations that defendant wrongfully charged fees to users of a platform through which money was uploaded for school lunches); Bacon v. Avis Budget Group, Inc., and Payless Car Rental, Inc., Case No. 2:16-cv-05939 (D.N.J.) (preliminarily certified as class counsel in $19 million settlement concerning allegations of fraudulent sales practices in consumer car rentals); JM et al v. Elnahal et al, 2:18-cv-17303-CLW (D.N.J.) (certified as class counsel in a matter in which class counsel obtained sweeping injunctive relief on behalf of the patients of Greystone Park Psychiatric Hospital).
Dave is a member of the New Jersey State Bar Association’s Class Action Special Committee and its Consumer Protection Law Committee. He is also the New Jersey Chair of the National Association of Consumer Advocates, and sits on its Judicial Nominations Committee.
