Greg Kohn, David DiSabato, and Lisa Considine of Nagel Rice, LLP obtained a $19 million nationwide class action settlement against defendants, Avis Budget Group, Inc. and Payless Car Rental, Inc. for Plaintiffs’ claims that Defendants imposed unauthorized charges on Payless rental customers across the country. The Complaint asserted that these companies charged customers for ancillary products, such as roadside protection and refueling charges, that were specifically declined or never revealed at all to the customer from January 1, 2016 through November 25, 2023.

The settlement provides significant relief to all customers from the United States and Canada who rented from Payless in the United States and paid for roadside protection or refueling. Each eligible Class Member will receive their pro rata share of the settlement. Each eligible Class Member will receive a share of the $19 million settlement and checks or digital payment without the need to file a claim. The settlement also provided for changes to the sale process to prevent future unauthorized purchases of ancillary services.
